Acceptable Use Policy

This Acceptable Use Policy ("AUP") outlines the rules, standards, and prohibited activities for all users of the SweepsMarket platform. By using the Service, you agree to comply with this policy in full. This AUP is incorporated into and forms part of our Terms of Service. Violations may result in immediate and permanent account termination, forfeiture of all entries and prizes, and referral to law enforcement authorities where appropriate.

SweepsMarket maintains a zero-tolerance policy toward fraud, manipulation, and abuse of the giveaway system. The integrity of every giveaway on the platform depends on all participants playing fair. Any attempt to game the system harms every legitimate participant and will be dealt with swiftly and permanently.

1. Sweepstakes & Giveaway Fraud

The following activities constitute sweepstakes fraud and are strictly prohibited:

  • Manipulating giveaway entries, entry counts, or odds through any unauthorized means
  • Exploiting bugs, glitches, errors, or vulnerabilities in the platform to gain entries or advantages
  • Attempting to tamper with, hack, reverse-engineer, or interfere with the entry process, random drawing, or any component of the giveaway system
  • Submitting entries using false, fabricated, or stolen identity information
  • Entering giveaways while ineligible (under 18, non-US resident, prohibited jurisdiction, employee of Sponsor/SweepsMarket)
  • Circumventing entry limits, cooldown periods, or other restrictions through any means
  • Attempting to predict, influence, or manipulate the outcome of any random drawing
  • Falsely claiming to be a winner or fabricating prize claims

2. Multiple Account Prohibition

Each individual may maintain only one (1) SweepsMarket account. The following are strictly prohibited:

  • Creating, registering, or maintaining more than one SweepsMarket account per person
  • Using different email addresses, phone numbers, or identity information to create additional accounts
  • Using a family member's, friend's, or any other person's information to create accounts for your benefit
  • Sharing account credentials with any other person or allowing any other person to use your account
  • Purchasing, selling, trading, or transferring SweepsMarket accounts
  • Using VPNs, proxies, or other tools to mask your identity in connection with multiple account creation

SweepsMarket employs advanced technical measures to detect multiple accounts, including device fingerprinting, IP address analysis, behavioral analysis, and cross-referencing of personal information. Discovery of multiple accounts will result in immediate and permanent termination of ALL associated accounts, forfeiture of ALL entries and prizes across all accounts, and a permanent ban from the platform.

3. Automated & Bot Activity

All giveaway entries must be submitted manually by a real human being. The following are strictly prohibited:

  • Using bots, scripts, macros, browser extensions, or any automated tools to enter giveaways, create accounts, submit referrals, or interact with the platform
  • Using automated systems, crawlers, or scrapers to access, collect, or extract data from the platform
  • Using auto-fill tools, form-filling software, or automation frameworks (e.g., Selenium, Puppeteer, Playwright) to submit entries or complete platform actions
  • Interfering with the platform's infrastructure, servers, networks, databases, or APIs through any automated means
  • Attempting to bypass, defeat, or circumvent CAPTCHA, rate limiting, bot detection, or other security measures
  • Using artificial intelligence or machine learning tools to automate platform interactions or entry submission
  • Load testing, stress testing, or penetration testing the platform without prior written authorization from SweepsMarket

4. Chargeback & Payment Fraud

WARNING: Filing a fraudulent chargeback against SweepsMarket is treated as fraud and will result in permanent account termination, voiding of ALL entries (past and present), forfeiture of any pending or awarded prizes, and potential legal action.

The following payment-related activities are strictly prohibited:

  • Filing a chargeback, payment dispute, or payment reversal on any legitimate SweepsMarket transaction, including Pro Membership charges and product purchases
  • Using stolen, fraudulent, or unauthorized credit cards, debit cards, or payment methods to make purchases on the platform
  • Purchasing a product to obtain bonus entries and then initiating a refund or chargeback while retaining the entries
  • Subscribing to Pro Membership to obtain bonus entries and then filing a chargeback while retaining the entries
  • Using payment methods belonging to another person without their authorization
  • Exploiting promotional codes, discounts, or coupons in unauthorized ways

Upon detection of chargeback fraud: (a) your SweepsMarket account will be permanently terminated; (b) ALL entries across ALL giveaways (past, current, and future) will be immediately voided; (c) any pending or awarded prizes will be forfeited; (d) you will be permanently banned from creating any new SweepsMarket account; and (e) SweepsMarket reserves the right to pursue legal action, report the fraud to law enforcement authorities, and report the chargeback to fraud prevention databases.

5. Referral & Affiliate Abuse

The referral program is intended for genuine, organic referrals of real individuals. The following are strictly prohibited:

  • Self-referrals: creating additional accounts and referring yourself
  • Referring fake, fictitious, or non-existent individuals
  • Creating or using "burner" email addresses or temporary phone numbers to generate fake referrals
  • Purchasing or selling referral codes, referral credits, or referral links
  • Distributing referral links through spam, unsolicited bulk messaging, or deceptive marketing
  • Posting referral links in contexts that misrepresent what SweepsMarket is or what the referral entails
  • Paying, incentivizing, or bribing people to sign up using your referral link (beyond the referral bonus itself)
  • Using bots, automation, or services that generate fake signups to earn referral entries
  • Manipulating the referral system in any way to earn entries that do not represent genuine, organic referrals of real individuals

SweepsMarket verifies all referrals and reserves the right to void referral entries that are determined to be fraudulent, fake, or obtained through prohibited means. Patterns of referral abuse will result in permanent account termination.

6. Coordinated Entry Manipulation

The following forms of coordinated activity are strictly prohibited:

  • Colluding with other users to cross-refer each other using fake or secondary accounts
  • Organizing groups, rings, or networks for the purpose of manipulating entry counts, referrals, or giveaway outcomes
  • Coordinating with other users to file simultaneous or strategic entries designed to manipulate odds
  • Sharing strategies, tools, or techniques for circumventing platform rules or entry limits
  • Operating "entry farms" or "referral circles" where multiple people coordinate to maximize entries through fraudulent means
  • Recruiting others to create SweepsMarket accounts solely for the purpose of generating referral entries for yourself or a third party

7. Impersonation

The following acts of impersonation are strictly prohibited:

  • Impersonating SweepsMarket employees, staff, support agents, administrators, or representatives
  • Impersonating Sponsor employees, representatives, or agents
  • Impersonating giveaway winners (past or present)
  • Impersonating the licensed third-party sweepstakes administrator
  • Impersonating other SweepsMarket users
  • Creating accounts or profiles that are misleadingly similar to SweepsMarket official accounts
  • Sending communications (emails, messages, social media posts) that falsely appear to be from SweepsMarket or a Sponsor
  • Claiming to represent SweepsMarket or a Sponsor without authorization

8. General Prohibited Activities

In addition to the specific prohibitions above, the following activities are prohibited on the SweepsMarket platform:

  • Using the platform for any illegal purpose or in violation of any applicable federal, state, or local law
  • Transmitting malware, viruses, worms, Trojan horses, or any other malicious code through the platform
  • Attempting to gain unauthorized access to any portion of the platform, other users' accounts, or SweepsMarket's systems
  • Harvesting, collecting, or storing personal information of other users without their consent
  • Engaging in any activity that could disable, overburden, or impair the proper functioning of the platform
  • Reselling, sublicensing, or commercially exploiting access to the platform without authorization
  • Using the platform to distribute unsolicited commercial messages (spam)
  • Interfering with or disrupting the experience of other users

9. Content Guidelines

Users who submit content to the platform (including profile information, comments, reviews, community posts, or any other user-generated content) must not:

  • Post content that is defamatory, libelous, obscene, pornographic, vulgar, or harassing
  • Post content that promotes or incites violence, hatred, discrimination, or illegal activity
  • Post content that infringes on the intellectual property rights, privacy rights, or publicity rights of others
  • Post spam, phishing links, malware, or any malicious content
  • Share personal information of other users without their express consent
  • Post misleading, false, or deceptive information about giveaways, prizes, SweepsMarket, or Sponsors
  • Post content that impersonates any person or entity, or falsely states or misrepresents your affiliation with any person or entity
  • Post content designed to manipulate, deceive, or mislead other users

SweepsMarket reserves the right to remove any content that violates this policy without prior notice and to suspend or terminate the accounts of users who repeatedly violate content guidelines.

10. Business Account Standards

In addition to all other provisions of this AUP, businesses using the SweepsMarket platform must:

  • Provide accurate and truthful business information and verification documents
  • Honor all giveaway terms, prize commitments, and Official Rules as filed with their licensed third-party administrator
  • Retain and use a licensed, professional sweepstakes administration company for all giveaways
  • Comply with all applicable federal, state, and local sweepstakes laws and regulations
  • Handle all lead data (user contact information) in compliance with applicable privacy laws, including CAN-SPAM, TCPA, CCPA, and GDPR
  • Not engage in deceptive marketing, bait-and-switch practices, or misleading prize descriptions
  • Not list products or prizes that are illegal, counterfeit, stolen, or otherwise prohibited
  • Maintain all necessary business licenses, permits, and insurance for their products and services
  • Fulfill prizes within the timeframe specified in the Official Rules
  • Issue required tax documentation (IRS Form 1099) to winners as required by law
  • Respond to winner verification and prize fulfillment inquiries in a timely manner

Failure by a business to meet these standards may result in suspension or permanent removal from the SweepsMarket platform, forfeiture of any remaining lead credits, and withholding of any pending payouts.

11. Enforcement

SweepsMarket takes violations of this policy seriously. Enforcement actions are determined at our sole discretion based on the severity and nature of the violation, and may include:

Warning

Written notice of the violation with instructions to cease the behavior. Issued for minor, first-time violations only.

Temporary Suspension

Account access is restricted for a defined period. All pending entries may be voided during the suspension period. Pro Membership may be paused.

Permanent Ban

Account is permanently terminated. ALL entries (past, current, and pending) are voided. All rewards, referral bonuses, and pending prizes are forfeited. The user is permanently prohibited from creating any new SweepsMarket account.

Legal Action

For serious violations involving fraud, financial crimes, or illegal activity, SweepsMarket reserves the right to pursue civil legal action and/or report the conduct to appropriate law enforcement authorities.

SweepsMarket reserves the right to skip lower-level enforcement actions for severe or repeated violations. For fraud, chargeback abuse, multiple accounts, and bot activity, SweepsMarket will typically proceed directly to permanent ban. All enforcement decisions are made at SweepsMarket's sole discretion and are final and non-appealable.

12. Reporting Violations

If you believe a user or business is violating this Acceptable Use Policy, please report it immediately:

All reports are reviewed promptly and treated confidentially. We do not retaliate against users who report violations in good faith. When reporting a violation, please include as much detail as possible, including the username or account in question, a description of the violation, and any supporting evidence (screenshots, URLs, etc.).
